This privacy policy governs the collection, use, and disclosure of personal information by:

References to "we," "us," or "our" in this policy mean Suba Aynkharan operating through RE/MAX Community Realty Inc., Brokerage ("the Brokerage").

This policy applies to personal information collected through:

  • The website realtorsuba.com (the "Site"), operated by VoxTN on behalf of the Brokerage.
  • Contact forms, home valuation request forms, consultation forms, and the email-subscribe form on the Site.

It does not apply to third-party websites linked from the Site.


3. What Personal Information We Collect

We collect the following categories of personal information when you submit a form on our Site:

We do not collect: payment or financial information, government-issued identification, or sensitive personal information (health, biometric, etc.) through this Site.


4. How We Collect Personal Information

We collect personal information:

  • Directly from you — when you voluntarily submit one of the Site's forms (Contact, Home Valuation, Consultation, or Subscribe to Market Notes).
  • Automatically — our website may use cookies or similar technologies to collect technical information (browser type, device, pages visited). See Section 10 (Cookies) below.

5. Why We Collect It — Purposes

We collect and use your personal information for the following purposes:

  1. Responding to your inquiry — to contact you regarding the specific request you submitted (viewing arrangement, valuation, consultation, etc.).
  2. Providing real estate services — to represent you in buying or selling residential property as permitted under REBBA (Real Estate and Business Brokers Act, 2002) and RECO regulations.
  3. Marketing communications — if you subscribed to Market Notes or gave consent on another form, to send you occasional East GTA real estate market updates. You may withdraw this consent at any time (see Section 9).
  4. Legal and regulatory compliance — to meet our obligations under applicable law, including PIPEDA, CASL, REBBA, and RECO regulations.
  5. Improving our services — aggregate, non-identifiable analytics to understand how visitors use the Site.

We will not use your personal information for any other purpose without first obtaining your consent or as otherwise permitted by law.


6. Our Consent Model (PIPEDA)

Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) is built on knowledge and consent. We collect, use, and disclose your personal information only with your consent, except in the limited circumstances where PIPEDA permits or requires us to do so without it.

  • Express consent — for sending you commercial electronic messages / marketing (Market Notes), as required by CASL. You actively opt in and may withdraw at any time (see Section 9).
  • Implied consent — when you voluntarily submit a Contact, Home Valuation, or Consultation form, your consent to use that information to respond to your specific request is implied by the act of submitting it.
  • Where consent is not required — in limited cases permitted by PIPEDA, such as a disclosure required by law, court order, or regulatory demand, or to detect or prevent fraud.
  • No condition of service — we do not require you to consent to any collection, use, or disclosure beyond what is necessary to provide the service you requested.

We retain personal information to meet our legal and regulatory obligations (including RECO/TRESA and CASL record-keeping) as described in Section 8.

We do not sell your personal information to third parties.


8. How Long We Keep Your Information

We retain personal information for as long as necessary to fulfil the purposes described above, or as required by law. Typical retention periods:

  • Inquiry records (no engagement): up to 2 years, or until you withdraw consent.
  • Transaction records: at least 6 years from closing, as required by RECO regulations.
  • Marketing consent records: until you unsubscribe plus 3 years (CASL record-keeping).

When retention periods expire, we securely delete or anonymize your information.


9. Your Rights

Under PIPEDA and applicable law, you have the right to:

  • Access — request a copy of the personal information we hold about you.
  • Correction — ask us to correct inaccurate or incomplete information.
  • Withdrawal of consent — withdraw consent to marketing communications at any time by clicking "unsubscribe" in any email or by contacting us directly. Withdrawal does not affect the lawfulness of processing before withdrawal.
  • Complaint — lodge a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca or call 1-800-282-1376.

10. Cookies

The Site may use cookies and similar technologies for:

  • Essential site functionality (session management).
  • Analytics (understanding aggregate traffic patterns).

You may disable cookies in your browser settings; this may affect Site functionality. We do not currently use advertising or tracking cookies from third-party ad networks.


11. Security

We take reasonable technical and organizational measures to protect your personal information from unauthorized access, loss, or misuse. These include encrypted transmission (HTTPS), access controls, and contractual obligations on our service providers. No method of transmission over the Internet is 100% secure; we cannot guarantee absolute security.

The Site may contain links to third-party websites (e.g., MLS®, RE/MAX Canada, community resources). We are not responsible for the privacy practices of those sites. We encourage you to review their privacy policies before providing personal information.


13. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page with a new "Last updated" date. Material changes will be communicated by notice on the Site. Continued use of the Site after changes constitutes acceptance of the revised policy.
